What is GPSR?
GPSR is a European Union regulation that aims to increase the overall safety of products placed on the European market. It was created as a response to the ever-increasing development of new technologies, the sale of digital products and the sale of online products.
Why is GPSR important?
The GPSR regulation aims to:
- Ensure the safety of all products, including those associated with new technologies.
- Meet the challenges posed by the growth of online sales, particularly through e-commerce platforms.
- Ensure better enforcement and more effective and uniform market surveillance.
- Improve the effectiveness of recalls of dangerous products in the hands of consumers.
What do the GPSR regulations cover?
The Regulation’s provisions cover both new and used, repaired or refurbished products. It applies to all sales channels, both stationary and online. Excluded from the scope of the Ordinance are products whose safety is regulated by separate legislation, such as medicines or food.
Who is affected by the new regulations?
The regulation imposes certain product safety obligations on all participants in the supply chain of consumer products that are placed on the market.
Examples of obligations include:
- Ensuring that the product complies with the general safety requirements of the Regulation.
- Including the importer’s contact information on the product label.
- Including clear instructions and information on product safety in a language easily understood by consumers.
What are the penalties for non-compliance with GPSR?
The draft Law on General Product Safety indicates that fines for failure by individual entities to comply with the obligations set forth in the text of the Regulation could be as high as PLN 1 million.
When does the GPSR become effective?
The General Product Safety Regulation (GPSR) will take effect on December 13, 2024.
